FMC Seeks Comments on Tariff Exemption

Important Notice – FMC Seeks Comments on Tariff Exemption Petition

Shortly after the NCBFAA filed its Petition with the Federal Maritime Commission seeking to have the agency exempt NVOCCs from mandatory rate tariff publication, the Commission has taken the initial steps to initiate the proceeding.  On August 5, 2008, the FMC published a notice to the public about the NCBFAA Petition and has invited interested persons to submit their views or arguments in reply to the Petition.  Anyone wishing to do so would be required to file an original and 15 copies that is to be directed to the Assistant Secretary, Federal Maritime Commission, 800 North Capitol Street, NW, Washington, D.C. 20573.  In addition, a copy of that is to be served on the NCBFAA General Counsel, Ed Greenberg, at 1054 Thirty-First Street, NW, Washington, 20007.  The Commission’s order also requires that a copy of those reply comments be submitted in electronic form by email to secretary@fmc.gov.

As indicated last week, a copy of the NCBFAA’s Petition is available on FABnet.  It also can be accessed from the FMC’s website, at http://www.fmc.gov/reading/Petitions.asp.

This is a very important proceeding for NVOCCs, and it would be very helpful for all members who would like to be able to avoid continuing to file or publish rate tariffs to submit their comments to the FMC in advance of the deadline.  Anyone needing assistance on this issue should contact Association headquarters.

The proceeding is now titled as Docket P1-08, Petition of the National Customs Brokers and Forwarders Association of America, Inc. for Exemption from Mandatory Rate Tariff Publication.

Alternate Fuel Tax Savings

 

Propane forklift truck customers could be eligible for a 50-cent-per-gallon tax credit as part of the SAFE Transportation Equity Act of 2005. The alternative fuel tax credit is a credit against the excise tax imposed on the retail sale or use of alternative fuels such as LPG (or propane).

Effective October 1, 2006 through September 30, 2009, this credit has the potential to provide thousands of dollars of savings annually!

 

What Are My Potential Tax Savings?

The potential tax savings would be the actual gallons (or gallon equivalents) of

alternative fuel used (or sold) in which the federal excise tax was paid (by you)

multiplied by 50 cents.

 

How Do I Claim The Credit?

Note that the forklift truck must be associated with a business or trade.

• Register with the IRS and be classified as an “Alternative Fueler.”

• This is accomplished by completing and mailing IRS Form 637 entitled

            Application for Registration for Certain Excise Tax Activities.

• If you already have a Certificate of Registry or a Letter of Registration, you are

            grandfathered in. However, everyone must be registered by July 1, 2007.

• File IRS Form 4136 (available at www.irs.gov) at the end of the taxable year.

            This form allows you to claim a credit against your income tax liability.

• The credit is refundable even if you have no further tax liability.
